Terms of Use

1. Eligibility

You must be at least 13 years old to use Arcana.

If you are under the age of legal majority where you live, you represent that you have permission from a parent or legal guardian to use the Services and make any purchases requiring such permission.

Arcana is not intended for children under 13.

You may not use Arcana if you are prohibited from doing so under applicable law.

2. What Arcana Provides

Arcana is a tarot interpretation, learning, entertainment, and personal-reflection platform.

Features may include:

• Digital tarot card draws
• Manual selection of tarot cards
• Recognition of physical tarot cards from uploaded photographs
• AI-generated tarot interpretations
• Clarifying cards
• Follow-up conversations with the Oracle
• Daily card experiences
• Saved readings
• A personal tarot Journal
• Recurring archetype analysis
• Life-theme analysis
• Historical reading insights
• Educational tarot content
• Physical Arcana tarot cards and other products
• Additional features we may introduce in the future

Features may change, be added, or be removed over time.

3. Tarot and Artificial Intelligence Disclaimer

Arcana uses artificial intelligence and interpretive tarot systems to generate content.

Tarot is inherently interpretive. Arcana's readings, Oracle responses, themes, card interpretations, and related content should not be treated as statements of objective fact or guaranteed predictions of future events.

Artificial intelligence may also produce responses that are incomplete, incorrect, unexpected, inconsistent, or inappropriate.

You remain responsible for evaluating any information provided through Arcana.

Arcana is for reflection and entertainment.

The Services are not a substitute for professional advice.

Arcana does not provide:

• Medical advice
• Mental health diagnosis or treatment
• Legal advice
• Financial or investment advice
• Tax advice
• Emergency services
• Professional counseling
• Professional relationship counseling
• Predictions guaranteed to occur

You should not delay seeking qualified professional assistance because of something generated through Arcana.

Do not make important medical, safety, financial, legal, employment, relationship, or other major life decisions solely on the basis of a tarot reading or Oracle response.

If you are experiencing an emergency or believe you or another person is in immediate danger, contact the appropriate emergency services or qualified professional rather than relying on Arcana.

4. Your Account

Certain features require an Arcana account.

You agree to provide accurate information and to keep your account information reasonably current.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• Activity occurring through your account
• Using reasonable safeguards to prevent unauthorized access
• Promptly notifying us if you believe your account has been compromised

You may not impersonate another person, create accounts through fraud or deception, or access another user's account without authorization.

We may suspend or terminate accounts where reasonably necessary to address fraud, security issues, abuse, violations of these Terms, or legal requirements.

5. Personalization Information

Arcana may allow you to provide optional information such as your date of birth, career, relationship status, personal summary, or other context.

If supplied, this information may be used to personalize future readings and other features.

You are responsible for deciding what information you provide.

You should not submit information that you do not want processed for purposes of providing Arcana's personalized features.

Updates to your profile may affect future readings but will not necessarily alter previously generated readings.

6. User Questions, Prompts, and Content

Arcana allows you to submit questions, prompts, photographs, profile information, and other content (“User Content”).

You retain any rights you have in your User Content.

You grant Waymark LLC a limited, non-exclusive license to host, store, reproduce, process, transmit, analyze, and otherwise use your User Content as reasonably necessary to:

• Operate Arcana
• Generate readings and Oracle responses
• Maintain your Journal
• Generate theme and archetype features
• Provide customer support
• Protect the Services
• Improve functionality
• Comply with applicable law

This license exists only for purposes connected with operating, supporting, securing, and improving Arcana and ends when the relevant content is deleted, except where continued retention is reasonably necessary for backups, legal compliance, security, dispute resolution, or other legitimate purposes described in our Privacy Policy.

You represent that you have the right to submit your User Content and that doing so does not unlawfully violate another person's rights.

7. Private Readings and Journal

Arcana is designed so that saved readings, Oracle conversations, Journal information, and personal themes are associated with the applicable user's account.

We do not intend these materials to be publicly visible to other Arcana users unless you affirmatively choose to share them.

If Arcana provides sharing features, you are responsible for information you choose to share outside the private Services.

Once information is shared with another person or through a third-party platform, we cannot control how that information is copied, stored, or redistributed.

8. Photo Recognition

Arcana may allow you to upload a photograph of a physical tarot spread for card recognition.

You agree to upload only images you have the right to use.

Do not intentionally upload images containing:

• Another person's private information
• Identification documents
• Financial information
• Passwords
• Confidential documents
• Illegal content
• Content that violates another person's rights

Images submitted for tarot-card recognition are intended to be processed temporarily and not retained by Arcana after recognition is completed.

Card identities and other information derived from the image may be saved if you continue with and save the resulting reading.

Recognition technology may make mistakes. You are responsible for verifying identified cards before relying on the resulting reading.

9. Artificial Intelligence Services

Certain Arcana functionality depends on third-party artificial intelligence services, including OpenAI.

Information reasonably necessary to generate a reading, Oracle response, summary, theme, or other AI-assisted feature may be transmitted to these service providers.

By using AI-assisted features, you authorize this processing as described in our Privacy Policy.

AI-generated content is provided “as is” and may not always be accurate or appropriate.

10. Subscriptions and Premium Features

Arcana may offer recurring paid subscriptions and premium features.

Pricing, billing frequency, trial periods, introductory offers, and included functionality will be displayed before purchase.

Unless otherwise stated, subscriptions automatically renew until canceled.

Purchases Through Apple

If you purchase an Arcana subscription through Apple's App Store:

• Payment is processed by Apple.
• Your Apple account may be charged at confirmation of purchase.
• Renewal and cancellation are managed through your Apple account and App Store subscription settings.
• Refund requests are subject to Apple's applicable policies.

Purchases Through Google

If subscriptions are offered through Google Play:

• Payment is processed by Google.
• Renewal and cancellation are managed through the applicable Google account and Google Play subscription settings.
• Refund requests are subject to Google's applicable policies.

We may use RevenueCat to determine whether your account has an active subscription or entitlement.

Canceling a subscription generally prevents future renewal but does not necessarily provide a refund for an already-paid subscription period.

Unless required by law or provided under the applicable store's policies, subscription fees are non-refundable.

11. Trials, Promotions, and Special Offers

Arcana may occasionally offer:

• Free trials
• Introductory pricing
• Founding-member pricing
• Promotional pricing
• Referral benefits
• Discount codes
• Other limited offers

Eligibility requirements and terms may vary.

We may modify or discontinue promotions at any time, subject to applicable law and any terms already promised to eligible purchasers.

Promotional offers have no cash value unless otherwise expressly stated.

12. Physical Tarot Deck and Merchandise Purchases

Arcana may sell physical tarot decks, accessories, or other merchandise through its website.

Physical product purchases are separate from Arcana digital subscriptions.

Payment for physical products may be processed by Stripe.

Product listings will provide applicable pricing and material product information before purchase.

Shipping

Shipping prices, locations, delivery estimates, and available shipping methods may be displayed during checkout.

Delivery dates are estimates unless expressly guaranteed.

We are not responsible for delays caused by shipping carriers, customs, weather, incorrect addresses supplied by the purchaser, or other circumstances outside our reasonable control.

Returns and Refunds

Our applicable return and refund policy for physical products will be displayed on the website or during checkout.

Nothing in these Terms limits any non-waivable consumer rights provided under applicable law.

13. Intellectual Property

Arcana and its associated materials are owned by or licensed to Waymark LLC.

This includes, where applicable:

• The Arcana name
• Logos
• Branding
• Website design
• Application design
• Tarot card artwork
• Card-back artwork
• Illustrations
• Graphics
• Written content
• Software
• Code
• Interfaces
• Generated templates and prompts
• Product photography
• Audio
• Animations
• Layouts
• Compilation and arrangement of content

Except as expressly permitted, you may not copy, reproduce, distribute, sell, license, publicly display, modify, reverse engineer, scrape, republish, create derivative works from, or commercially exploit Arcana materials without authorization.

Nothing in these Terms transfers ownership of Arcana intellectual property to you.

14. Limited License to Use Arcana

Subject to these Terms, Waymark LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Arcana for your personal, non-commercial use.

You may not use Arcana to build, train, benchmark, copy, or develop a competing product or service without our written permission.

15. Acceptable Use

You agree not to:

• Use Arcana for unlawful purposes
• Attempt to access another user's private account or data
• Attempt to circumvent subscription restrictions or paywalls
• Reverse engineer or interfere with Arcana's software or systems
• Probe, scan, or test Arcana systems for vulnerabilities without authorization
• Circumvent rate limits or security controls
• Introduce malware or malicious code
• Automate excessive requests or otherwise abuse AI features
• Scrape or systematically extract Arcana content or tarot artwork
• Use Arcana infrastructure to distribute spam
• Use Arcana to infringe intellectual property rights
• Attempt to obtain confidential system prompts, API credentials, source code, or security information
• Use Arcana in a way that materially disrupts the Services for other users

We may restrict access where reasonably necessary to protect Arcana, our users, our service providers, or our systems.

16. Marketing Communications

Creating an Arcana account does not automatically subscribe you to marketing emails.

If you separately opt in to the Arcana community, newsletter, or marketing communications, we may send you information about:

• Tarot
• Arcana features
• New products
• Community news
• Physical deck releases
• Promotions
• Editorial content
• Related offerings

You may unsubscribe from promotional emails at any time.

We may continue to send transactional or service-related communications when reasonably necessary to operate your account.

17. Third-Party Services

Arcana may rely on third-party platforms and providers such as:

• Apple
• Google
• Supabase
• OpenAI
• RevenueCat
• Stripe
• GoHighLevel

We do not control every aspect of third-party services.

Their availability, policies, terms, security practices, and functionality may change independently of Arcana.

Your use of third-party services may also be governed by separate agreements between you and those providers.

18. Availability and Changes to the Services

We work to provide a reliable experience, but we do not guarantee that Arcana will always be available, uninterrupted, secure, or error-free.

Features may occasionally be unavailable due to:

• Maintenance
• Updates
• Technical problems
• Third-party outages
• Internet connectivity
• Security events
• Legal requirements
• Changes in third-party services

We may modify, update, suspend, or discontinue parts of Arcana from time to time.

Where reasonably practical, we will avoid making changes that improperly deprive users of paid access they have already purchased.

19. Account Deletion

You may initiate deletion of your Arcana account through the application as provided by Arcana.

Deleting your account is intended to permanently remove the account and associated user information from active Arcana systems, except information that we are legally permitted or required to retain.

Account deletion may result in permanent loss of:

• Saved readings
• Journal history
• Oracle conversations
• Recurring archetypes
• Life themes
• Profile information
• Other account-specific content

Deleted information may not be recoverable.

Deleting an Arcana account does not necessarily cancel an active Apple App Store or Google Play subscription.

You are responsible for separately canceling recurring subscriptions through the platform where you purchased them.

20. Termination

You may stop using Arcana at any time.

We may suspend or terminate access if we reasonably determine that you:

• Materially violated these Terms
• Used Arcana unlawfully
• Threatened the security of the Services
• Engaged in fraud or abuse
• Attempted unauthorized access
• Created material risk or harm to Arcana or another person

Where appropriate, we may provide notice or an opportunity to resolve the issue.

Sections that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, disputes, and amounts owed.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCANA AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WAYMARK LLC DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• ARCANA WILL ALWAYS BE AVAILABLE OR ERROR-FREE
• TAROT INTERPRETATIONS WILL BE ACCURATE
• AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE
• ANY PARTICULAR EVENT WILL OCCUR
• A READING WILL PRODUCE A PARTICULAR OUTCOME
• ARCANA WILL MEET EVERY USER'S EXPECTATIONS

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYMARK LLC AND ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO ARCANA OR THESE TERMS.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, GOODWILL, OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYMARK LLC'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID DIRECTLY FOR ARCANA SERVICES DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• ONE HUNDRED U.S. DOLLARS ($100).

These limitations do not apply where prohibited by law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Waymark LLC and its owners, members, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your unlawful use of Arcana
• Your material violation of these Terms
• User Content you submit in violation of another person's rights
• Your infringement of intellectual property or privacy rights
• Fraudulent or intentionally harmful conduct

This provision does not require you to indemnify Waymark LLC for conduct for which indemnification may not lawfully be required.

24. Governing Law

These Terms are governed by the laws of the State of [STATE OF ORGANIZATION], without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Any dispute that is not otherwise resolved will be handled in an appropriate court with jurisdiction under applicable law.

Nothing in this section eliminates rights you may have under mandatory consumer-protection laws.

25. Apple-Specific Terms

If you download Arcana through Apple's App Store, you acknowledge that:

• These Terms are between you and Waymark LLC, not Apple.
• Waymark LLC, not Apple, is responsible for Arcana and its content, subject to applicable law.
• Apple has no obligation to provide maintenance or support services for Arcana.
• Your use of Arcana must comply with applicable App Store terms and rules.
• Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your licensed use of the application where required by Apple's applicable terms.

Nothing in these Terms is intended to conflict with mandatory Apple App Store requirements.

26. Changes to These Terms

We may update these Terms as Arcana evolves.

If we make changes, we will update the “Last Updated” date.

For material changes, we may provide additional notice through the app, website, email, or another reasonable method.

If applicable law requires affirmative consent to a material change, we will request it.

Continued use of Arcana after updated Terms become effective constitutes acceptance of those Terms where permitted by law.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, subscription, promotion, or purchase, constitute the agreement between you and Waymark LLC concerning Arcana.

If a provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Our failure to enforce a provision is not a waiver of our right to enforce it later.
